students alone. a school resource officer spoke with the student who shook his head like he understood what was going on but then the bullying continued with text messages on facebook and in person. britton middle school wanted it to start and the 13-year-old ended up cited that morgan hill police issued saying it's technically the same as an arrest for a juvenile. the student harassed two other 13-year-old students verbally, physically, once even shooting plastic bbs at them. the principal says this behavior doesn't belong on or off campus. >> if it has an effect that reaches into the school where it affects the school climate, we're going to do what we can to work with law enforcement to make sure that's corrected. >> morgan hill police say the bully was trying to get the other students to use marijuana and when they declined, the

relationship was severed. apparently a number of parents are supporting this zero tolerance policy. the student we are told has been disciplined at the school but because he's a child, the principal couldn't elaborate on how he was disciplined. reporting live in morgan hill, christie smith, "today in the bay." school officials in the east bay are investigating another extreme bullying incident that ended with a student being flown to a hospital with serious head injuries. the principal of freedom high school say a girl attacked one of her classmates in the cafeteria thursday after planning the fight with friends on instagram. the victim hit her head and had to be air lifted to a hospital. the girl who attacked her was arrested on suspicion of felony battery. san jose police are now on the hunt for multiple suspects linked to the city's third homicide of the year. officers arriving at southside drive near hope street at 8:30 last night. they found a man who had been

stabbed multiple times. witnesses say several men attacked that victim. police were on the scene well into the morning collecting multiple pieces of evidence. they say they have not made any arrests so far. officers have not yet released a description of the suspects are a motive for this attack. this marks the city's second homicide in two days. also in san jose, we have learned one man in custody right now, two others still at large following a home invasion robbery in one of the city's safest neighborhoods. police say three men forced their way into a home monday night. they reciportedly ransacked tha house and tied up the elderly woman that lived inside. they left in their two cars which were found on wednesday. police hope evidence inside these vehicles will lead them to suspects. school officials in berkeley are working on new safety measures for students but those measures could come with a big price. the board approved contracts

with two companies that specialize in threat assessment and another that focuses on disaster preparedness. the school district plans to spend about a half million dollars on safety improvements. the safety plan is in response to the deadly shootings at sandy hook elementary school in newtown, connecticut, last month. ed lee taking steps to make sure 49er fans don't get out of control on the night of the super bowl. city officials are hoping to avoid a repeat of this. the violence and vandalism that took place after the giants wrapped up that world series victory last year. very ugly in some places. lee says city officials will meet with small businesses to try to discuss new ideas. the mayor also warning bars to be careful how much alcohol they are serving and he says they may ask bars to stop selling alcohol at the end of the game. several streets will be closed off to cars and police will be out in force. oakland's coliseum about to

is 56. four degrees away from average to start the day. temperatures because we're starting out so mild with enough sunshine from time to time throughout the day today we're going to climb to 70 degrees in some cities. wait until i show you your city by city breakdown. slick conditions. plan on a wet drive to work and count on slowing down more than usual for a friday morning. we'll check on that drive with mike in just a moment. he's standing by. showers will continue for the first part of the morning. we'll see a nice break between 9:00 and 12:00. showers start to move into the bay area. mostly very isolated. you will want to keep your umbrella handy if you are wearing something nice to work today. you want to keep it protected. these are the showers where you can bolt wherever you are headed without getting too wet. 65 in livermore pch. 62 in san jose. we stop the clock on future cast to let you know we do have showers in the forecast as we head through your saturday and sunday. we'll time those out in my next report. as promised, here's mike inouye.

went into effect three weeks ago but until now drivers were given warnings. starting this weekend those warnings are over during that grace period more than 11,000 of the warnings were handed out. city officials expect the new pay to park on sunday plan will generate nearly $2 million in revenue. >> going from "star trek" to "star wars." j.j. abrams will direct the next chapter. the "star trek" director and "lost" creator signed onto direct the seventh film of the franchise scheduled to be released in 2015. fans have had a mixed response to this news. some congratulated him on his facebook page while others started a petition on change.org asking disney to change their mind. coming up, there's new rules that could change the face of high school sports nationwide. where you can get an up

a lot of unrest going on in egypt. today marking the two year date since the start of the revolution that ousted hosni mubarak. protesters throwing rocks at police in tahrir square. police firing tear gas back into the crowd. looks like things have calmed down as demonstrators early set fires and tried to tear down a wall at the parliament and cabinet building. we'll of course keep you posted on how that aggression progresses there. it's 5:14. time for a little bit of business and tech. apple says it discovered more children working at its factories. scott mcgrew, the company has been up front about this. >> it has. we should applaud that.

no matter what you think of working conditions of people that make your iphone, no american wants them to be children. apple says it performed 72% more factory audits this time than this time last year covering 1.5 million workers. in that 1.5 million, it says it found 70 children workers at a subcontractor. that is .004% of its workers. what sounds like a big number is small by scale. the same issue came up with worker suicides at factories a few years ago. they are tragic and awful but the suicide rate was standard for population. apple stock crushed thursday following the company's financial reports down $63 or 12%. $47 billion in market capitalization cease to exist in just a few hours of trading. quite possibly the worst one-day loss in silicon valley history. ironically the stock markets

themselves have been doing fairly well especially if you take apple out of the equation. let's turn to kayla tausche live at cnbc world headquarters. good morning. >> good morning, scott. we do have futures that are higher today. that is despite some so-so earnings last night from microsoft and starbucks. stocks are mixed on thursday. apple as you mentioned weighed heavily on the nasdaq. today we get data on new home sales and earnings from procter & gamble. the dow closing up 36 points to 13,825. that's the highest level since october 2007. scott, back to you. >> thank you very much. have a great weekend. jon and marla, new app to show you this morning for your iphone. it hit the app store on thursday morning. it's video for twitter. these videos have to be six seconds. twitter is 140 letters.

have that for you and if you like rain, we have that for you as well. so someone is going to complain on my facebook page. 53 in san jose. 52 degrees in gilroy. very unusual to be sparing the air with these showers that came through and purified our air quality somewhat yesterday. unhealthiest levels are places that didn't receive all of that rain. we had quite a bit of activity in the south bay but by 9:00 today we'll start to see showers thin out for a time. they'll be back in the mix as we head throughout the second half of the afternoon into the evening hours. you made it to friday. there is success in that department at the very least. if you want to get outdoors this weekend, we do have showers around. you'll be able to get outdoors. make those plans. just count on maybe getting hit by a stray shower or two. but nothing heavy. 65 degrees in livermore. 67 degrees in gilroy. 65 degrees in los gatos. your seven-day outlook helping you plan your weekend. you made it. 56 degrees by saturday. it will be chilly.

and toll plaza, easy drive. this is a blip. no incidents in downtown oakland. no incidents for chp report. there you go. bay bridge a live look out there to see how things are. a few more cars. no major puddling. smooth drive. maybe slick roads. peninsula will get a look over here to palo alto as well. traffic going north toward willow and into the city fine. south just fine. quick look at the north bay. a few more cars but just a few. back to you. >> looks good for a smooth friday. there could soon be sweeping changes to high school sports programs and it's happening nationwide. the u.s. education department telling schools they must include disabled students in all sports or provide an equal alternative. this rule requires schools and officials to make reasonable modifications to all athletic programs to allow disabled students to participate. schools that don't comply risk losing federal funding. supporters say the new rule could do for disabled athletes what the ground breaking title 9 rule did for female student

athletes. follow-up for you now. it appears age may be to blame for a water main break in a marin county neighborhood. this is what the scene looked like yesterday morning. hundreds of thousands of gallons of water gushed on the road for an hour and a half. water district officials say the four-inch pipe that burst is more than 60 years old and a valve may have broken. an iconic work of art will be on display in san francisco starting this weekend. the girl with a early earring is one of 35 masterpieces on loan. this painting often referred to as the dutch mona lisa. a lot of people have been inspired with different theories about her identity. the display is open to the public tomorrow and it will run through june 2nd. a chance to get culture in your life. >> i'm sure that will be a popular one.

about to hit an amazing milestone. how about 50,000 races. russell baze is scheduled to ride today. the sixth one would mark 50,000. he's won close to 12,000 races in his career. that's a north america record. he's already in the u.s. racing hall of fame. that sixth race is scheduled today for 3:15. a last-ditch effort to keep the kings in sacramento could include oracle founder larry ellison. he will soon meet with sacramento mayor kevin johnson about trying to buy the kings. johnson is trying to gather investors to help keep the team from moving to seattle. ellison has the money to help and he's interested in basketball. seems like a good combination. he's worth $41 billion and unsuccessfully tried to buy the golden state warriors in 2010.

this next story swept the nation. the guy became an icon. palo alto native and nba star jeremy lyn will highlight the film festival. he'll be in utah sunday night to screen his new flick. this chronicles his rise to superstardom status that happened last season when he was with the new york knicks. he's now with the houston rockets after signing for a big fat new contract. just so happens the rockets do have a game against utah. the jazz will take them on monday night. so lin can be there. >> forgive me. do we know who did the flick? >> his brother is involved as one of the directors on this. i'm sure lin himself will get an executive producer as well. >> very cool. meteorologist christina loren. wet roads to start the friday. >> have to love jon kelley.

we have some good looking spotty showers right now. nothing that you really need to allow all that much extra time for according to mike. not a lot happening out there at this moment. we'll check with him in just a moment. he just gave me the sign there's something new. we have rain coming down right now. we'll see showers subside by 8:00 a.m. temperatures are mild out there. it feels balmy. by noon, 57 degrees. already exceeding beyond our seasonal averages. we'll round out the day at 67 degrees inland. it's a spare the air day but so mild out there you don't need to burn a fire this morning. let's help out that air quality. unfortunately the showers just weren't enough. it's enough rain out there to slow the drive this morning, wouldn't you say, mike? >> you should slow the drive because of that slick conditions but also that mist. the drizzle might be enough to have windshield wipers come on and that would impair your view. san mateo bridge, we can't make out much beyond halfway across that flat section. once you are there, you have a good distance for the drive as far as visibility goes. it's just from the hayward side.

just slowly rolling by the city by the bay on this friday, january 25th. this is "today in the bay." good morning. thanks for waking up with us. i'm marla tellez in for laura garcia-cannon. >> i'm jon kelley. good morning, everybody. new this morning, san jose police looking for several suspects linked to the city's third homicide of the year. a man found stabbed multiple times near southside drive and hope streep in south san jose last night. investigators say four to five men approached the victim and then attacked him just before 8:30 last night. police still trying to figure out a motive. >> in a gang related incident we'll hear gang epithets being uttered. none of our witnesses report hearing anything like that.

when you have a group of people that attack someone, it sounds that way. we don't know yet. it's too early to tell. >> the suspects were last seen leaving that screen driving a gray colored van. this marks the second homicide in just two days. threats, taunts and online messages have a middle school student in morgan hill facing serious legal consequences this morning. the 13 year old has been arrested for cyberbullying. "today in the bay" christie smith is live in morgan hill with more on how it started and how the school has responded. >> reporter: happy friday. it may sound harsh on the surface but many parents we spoke to in morgan hill feel good about the outcome. they are glad that the school and the police department stepped in and stopped the bullying all together. according to police, a 13 year old made threats face to face through text messages or even on facebook and even after a school resource officer at britton

middle school told him to stop and he nodded like he understood. at one point they are saying that he even shot at these two 13-year-old classmates with a plastic bb and the principal says bullies don't belong off or on campus. police arrested and cited this 13-year-old boy and this climate now administrators and parents are very concerned about keeping kids safe. >> all of us, i think, have been bullied at some point or attempted to have been bullied by somebody and it's not fun. we'll never forget it. >> reporter: police tell us that this bully was trying to get the other two students to use marijuana and when they declined, their relationship was severed. the student was also disciplined at school but the principal couldn't say how he was disciplined because he was a child. he's also going to be sent to the juvenile court system and have a hearing coming up with

his parents. reporting live in morgan hill, christie smith, "today in the bay." also new this morning, parents in antioch warned to keep a close eye on their children after an attempted kidnapping outside of a school. police say yesterday afternoon a man tried to lure a fifth grade boy into his car near sutter elementary school. he told that boy he was sent there by a relative. the boy smartly responded and said "i don't know you" and quickly walked away. that suspect is being described as a white man with gray hair and was said to be driving a light blue '70s era car. an oakland teen that killed his adoptive parents last year will be sentenced today. moses cayman was just 16 years old when he strangled susan and robert cayman. he told police he killed them because he didn't want to deal with them being upset after he got suspended from school for smoking marijuana. san mateo county planning to hold a gun buyback program this weekend. you have probably heard about

it. a lot of recent buyback events in the bay area. a big success in marin recently. they've seen huge turnouts. marin's event had so many that they ran out of money and had to issue ious. this one will run from 10:00 a.m. to 2:00 p.m. gun owners receive 100 cash for guns, shotguns and rifles and up to $200 for assault weapons. police still stressing no questions will be asked about guns being turned in. tens of thousands of bay area students may soon be forced to look for a new community college. the head of the state's community college system tells city college of san francisco's board the college is not too big to fail. ccss is in a financial crisis and on the brink of losing its accreditation. they have until march 15th to

prove it deserves to stay open. board members say that faculty and staff are resisting changes and warn that the school is still a long way from getting its finances in order. the shooting of a couple mountain lion cubs in half moon bay last month may now change how california deals with big cats. the 4-month-old cubs were sadly fatally shot by a game warden after they were found hiding under a porch on december 1st. today state senator jerry hill introducing a bill requiring fish and wildlife wardens to use nonlethal means when dealing with mountain lions in suburban areas unless there's an imminent threat to human life. this law would authorize wardens to partner with local wildlife groups or zoos to care for injured or orphaned mountain lions. a benefit concert series continues for injured giants fan bryan stow. the giants third base coach tim flannery and his band will

perform tonight in mill valley. tickets start at $50. organizers say the money raised will be donated to the stow foundation. the concert will be held at sweetwater music hall in mill valley at 9:00 tonight and then tomorrow the concert series moves to napa and wraps up sunday night in santa cruz. so far coach flannery and his band raised some $70,000 for the stow foundation. it is 5:36 right now. a lot of reasons to feel good today. it is friday. and christina loren says we've got temperatures that feel like it's springtime. >> it will be nice temperaturewise. we do have showers on the radar. bizarre weather today. i love days like this. it's a little something for everybody. of course everybody likes different components of the bay area weather. right now you can see the showers are starting to thin out. starting to subside. we'll get a break. especially between the hours of 9:00 a.m. and noon and then after that time we'll see some showers come through. i want to point out what's happening. we have an area of low pressure

riding in from the north. we're sandwiched between systems right now. another area of low pressure to our south. that's the one impacting us. this is the one that will continuously bring us showers throughout the day. subtropical showers which is why our highs will end up close to 70 degrees in some cities. we stop the clock at 10:00 a.m. just low clouds hanging out mostly over the east bay down through the south bay as well. you'll see some sunshine at the coast. at noon, showers start to develop over the higher elevations. that will continue through 2:00 p.m. look at your highs. we'll see enough sunshine today and we're starting off so mild. 68 degrees in gilroy. unusual. 66 in livermore. 67 degrees in santa cruz. not a great beach day in terms of sunshine. if you want to sit out there on the sand to watch those waves, it will be nice today. 67 degrees. can't beat that in january. mike, you're a local boy. this is unusual. >> we have rain and weird weather and the spare the air on a rainy day doesn't usual

happen. we're concerned about the fact that there are wet roadways and we'll watch that. the toll plaza you see drops but not a big deal. oakland you'll find drying roadways but still slick on the off-ramps. earlier issue here as we look at the maps north 880 at 7th a deer cleared from the roadway but light volume not a problem for folks heading through the construction zone. you do slow for the cone zone. approaching the incline, slowdown as volume increasing just a bit. as we look at berkeley looking down east shore freeway with headlights picking up a few more as far as volume and north bay the same. a light increase to san rafael. back to you. it's 5:38. we can tell you the giants world series trophies are out on tour. very few people win them. now you can see them. we'll let you know where you can get up close with those pieces of team history today. plus loud and muddy. a live look at what's under way

january 6th. we went 20 days without any significant rainfall. we're still doing really well in totals because of wet december we had. this is another drop in the bucket this morning. light showers coming down. nothing heavy. enough to keep those roadways nice and slick in addition to showers developing. throughout the day, i want to take you through future and show you future cast and stop the clock for you at 10:00 a.m. mostly cloudy conditions. done with showers at that point. you'll be able to get outdoors. getting the mail will be easier. when we hit 12:00 to 1:00, light activity over the higher elevations. north and south bay have the best chance of seeing the showers today. we're sandwiched between two weather systems. it's an interesting setup. because it's so mild out there to start and most of our shower activity is creeping up from the south from a warm system, we're still going to hit highs close to 70 degrees today. 68 in gilroy. 65 in los gatos. right around 63 degrees even in san francisco.

san francisco right now at 52 degrees. just four degrees away from the average high. that's an indication of a nice comfortable day to come temperaturewise. however, we're going to have to deal with showers over the course of the weekend. we'll time those out for you in my next report. we want to check on the drive. >> i'm going to use the same shot that you showed for san jose. this is indeed 280 at 17. volume picking up a little bit. i want to show you the headlights and number of headlights that we're looking at not a big deal. glow of the headlights and mist in the air. that's what you're dealing with on the roadways. slicker conditions. let's look at the maps for the same area. we are talking about on maps integrated traffic and weather we show orange, mist and drizzle and maybe enough of a factor to impair your view. a little bit of the roadway you may have to use wipers for 85 north from 87 into cupertino. you see the same for 101 out of morgan hill and gilroy. northbound 101 starts to show slowing as you come up north of 680. that's traditionally the first burst we see before 6:00 and

fees paid. they hired a collection agency to go after people with more than $20 in overdue items. the collection agency can alert credit organizations if the item is not returned or paid for. that in turn can actually lower a person's credit score. >> time to crackdown. scott mcgrew says along with returning your books, just watch more tv. he joins us with tv gadget friday. scott, the tv is backwards. what's going on. >> it is. forget books. let's talk about television. if you are familiar with internet enabled televisions that can scream net flicks, hulu, you don't have one you can hook up. now manufacturers are shrinking the technology down to a stick. here's a close up. it's called the smart stick from a company that is powered by google's android bringing internet connection to your
